Expired Section 301 China Exclusions Extended!

On March 23rd, the U.S. Trade Representative (USTR) announced the extension of 352 expired product exclusions from Section 301 China tariffs. 

The extensions are the result of a request for comment by the USTR in November 2021 asking for input on the extension of 549 Section 301 exclusions that had expired.

We suggest reviewing the exclusions available against products imported on October 12th and later for refund opportunities.


Effective Dates: The expired exclusions will resume as of October 12th, 2021, and remain in effect through December 31st, 2022.

Harmonized Tariff Schedule (HTS) Subheading Covering the Exclusions:  9903.88.67  

Details:

  • The reinstated exclusions are available for any product that meets the description in the product exclusion.
  • The exclusions will apply to goods entered for consumption, or withdrawn from a warehouse for consumption, on or after 12:01 a.m. EDT on October 12, 2021, that are not liquidated or to liquidated entries within the protest period.
  • Duty refunds on eligible goods may be requested by filing a Post Summary Correction (PSC) or Protest once U.S. Customs & Border Protection (CBP) implements the functionality to file the new subheading.
