Lacey Act Phase VII Enforcement Starting as Soon as December 2024

On May 31, 2024, the U.S. Department of Agriculture’s Animal Plant Health Inspection Service (APHIS) announced a comment period for Phase VII of the Lacey Act. Assuming no additions or changes arise from the comments provided, Phase VII is expected to begin on December 1, 2024. U.S. Importers bringing in products under Phase VII will need to declare the goods to APHIS at the time of import.

The public has until July 30, 2024 to comment on products covered under Phase VII (see below), and on whether any additional Harmonized Tariff Schedule (HTS) chapters should be included in the current phase-in schedule. If there are additions to Phase VII, APHIS intends to provide at least six months’ notice.

The list of HTS codes for Phase VII is extensive, including all remaining plant products that are not 100% composite materials. It is crucial that importers check the goods they import for any plant product material against the list below. If a product appears on the list below, it will require a Lacey Act declaration at the time of import into the USA.

The Lacey Act combats the illegal trafficking of wildlife, fish, and plants. It is unlawful to import into the U.S. any plant or plant product that was illegally harvested.
