Will the Section 301 China Tariffs Begin Expiring?

On July 6th, it will be four years since the implementation of Section 301 China tariffs.

The tariffs will automatically expire on their 4th birthday unless the U.S. Trade Representative (USTR) takes specific actions, including a review within 60 days of July 6th.

Of the four lists, List 1 (HTS 9903.88.01) would expire first on July 6th, followed by List 2 (HTS 9903.88.02) on August 23rd.

The USTR may ask for comments from the public on renewing the tariffs.


Status of the Renewal of 549 Expired Exclusions

**Updated 03/23/2022** The USTR extended 352 of 549 certain exclusions. The extended exclusions are effective from Oct 12, 2021 – Dec 31, 2022.

Expiration of Remaining Product Exclusions 

On May 31st, eighty-one product exclusions are scheduled to expire. The exclusions are related to Covid medical care products. This set represents the last of the product exclusions available for importers.
